What It Is And What You Need to Know About It

Buyers Inspection NoticeWhat to know about the Buyer’s Inspection Notice Seller’s Response or “BINSR” when buying a home in Arizona.

It is an important form in every Arizona real estate transaction. Home buyers use it to request repairs based on the home inspections they have done.

It is an addendum to the Arizona Association of Realtors Residential Purchase Contract. The Buyers Inspection Notice is an organized way for Buyer to request repairs and the Seller to respond to that request.

Even when a buyer doesn’t do any inspections, the BINSR is still used. In this case, the buyer indicates on the BINSR that they are accepting the premises “AS IS”. No repairs requested.

The Buyers Inspection Notice identifies all repairs the buyer wants the seller to do. It must be in the hands of the seller before the end of the inspection period.

If NOT, the buyer waives their right to request repairs by the seller.

The Inspection Is Done….Now What?

Upon receiving the Tucson home inspection Report, the Buyer has 3 courses of action. Each of these actions requires the Buyers Inspection Notice.

1- Accept the home without requesting any repairs and proceed to closing.

2 – Reject the home based upon the issues raised by the inspection.

3 – Formally request the seller to make stated repairs to the home.

When The Buyer selects #3

We will prepare the “Buyer Inspection Notice Seller Response” form.  It identifies all repairs the buyer want the seller to make.

The Seller now has 3 options:

1 – Agree to make all requested repairs and proceed with the sale.

2 – Agree to make some, but not all, of the requested repairs.

3 – Refuse to make any repairs.

Should the Seller select either option 2 or 3;

The Buyer now has TWO (2) options

1 – Cancel the contract due to the Sellers not making all repairs

2 – Accept the Seller not making repairs and proceed with the purchase.

While this process sounds complicated it is actually straightforward.

The Arizona residential purchase contract sets forth all standard timelines. But if agreed to, the buyer and seller can agree to change them.

We are, of course, there to explain and review the options available in each step in the process.

In Arizona a home inspection occurs when a buyer makes an offer on a property and the seller accepts the offer.

The buyer has 10 days to hire a home inspector and complete all inspections.

Once agreed upon, the seller is to complete all agreed to repairs before close of escrow. The seller must also provide paid receipts for the repairs to buyer 3 days before the close of escrow.

But sometimes contractor scheduling gets in the way of meeting the deadline. And sometimes Buyers want to close escrow before the seller completes the repairs.

There are many reasons for this, but it is never a good idea to do it.

So, what are the risks?

The Scenario:

After the home inspection and Buyers Inspection Notice submission, the Seller agreed to complete a roof repair requested by the Buyer.

But due to scheduling, the roof contractor could not complete the repairs before the close of escrow. But the buyer still wants to close on time and move in.

So what do they do now?

The seller purposes, and the Buyer agrees, a perfect solution. The seller will pay the roof contractor’s invoice to repair the roof at close of escrow. Making the payment from the proceeds from the sale of their home.

Then the contractor will complete the repair after the close of escrow.

The Seller asks the roofing contractor to submit an invoice. The key point here – it is not a proposal!

Sounds like a good plan, right? WRONG!

Almost all the risk is on the buyer with this plan of action.

What are the risks?

For one, the roofing contractor gets paid at close of escrow. Before completing the work

Since the contractor has the money, they could delay the repair work. They might schedule new work ahead of the buyer’s home. Remember, the work is already paid for.

The contractor might not complete the job or not complete it in a workmanlike manner.

NOTE – Seller and Buyer could agree to an “escrow hold-back” at close of escrow. The escrow company holds the funds. In this situation, the roofing contractor would not be paid until the repairs were completed to the Buyer’s satisfaction. Any cost over runs would still be the Buyers responsibility.

DANGER!

What if the job needs more work to complete. More than the contractor got paid. These added costs will be the Buyers responsibility.

Our recommendation is ALWAYS wait for the repairs before closing escrow.

How?

The simplest way is for the Buyer and Seller to extend the close of escrow date. This allows the work to get done AND the Buyer to do a final inspection or “walk through”.

Inspections All Buyers Should Consider

Tucson Termite Inspection and Tucson Roof Inspection also provide valuable information to the Buyer’s purchase decision. Some Buyers want to have Tucson Radon Inspection or Tucson Mold Inspection.

Tucson Mold Inspections A Mold Inspection in Arizona isn’t common. But should the home inspector identify mold, they will bring it to your attention and include the finding in their report.

If that happens, it is wise to have a separate mold inspection done.

The challenge is the timing. The “Due Diligence” section of the contract sets the time to complete ALL inspections.

The “standard” inspection period is 10 days. But as a buyer you could extend it. Say, to 15 days.

So, if you are buying an older home, scheduling a mold inspection right away is a good idea.

Should mold be present, request the Seller of the home have the mold analyzed by a licensed company. And, based on that mold inspection report, the seller takes actions to mitigate the problem.

As with all Tucson Home Inspections, the mold inspector will provide a written report of their findings.

It is worth noting that there aren’t many Mold Inspectors in Tucson. So, if mold is suspected, plan ahead and schedule one early in the inspection period.

Tucson mold inspections should only be conducted by an industry-certified and experienced company with the background and merits that promote consistent quality.

However, should one be needed, we will suggest companies we have previously worked with.

The Buyers Inspection Notice And Seller’s Response – BINSR

Should mold be detected, the Tucson Home Buyer should request the Seller undertake proper mold remediation.  This request is made using a “standard” Arizona Department Of Real Estate form.  The Buyers Inspection Notice and Seller Response form.

It is affectionately known as the “BINSR”.

Other Inspections To Consider

Tucson Termite Inspection and Tucson Roof Inspection also provide valuable information to the Buyer’s purchase decision. Some Buyers want to have a Tucson Radon Inspection or Tucson Pool Inspection.

Tucson Home Inspection should always be completed and may identify the need for other inspections such as a Tucson Structural Inspection. Should the property have a septic system a Tucson Septic Inspection will be required.

After You Buy Your New Home

R22 Freon Is Banned – But NOT Extinct – For Now

R22 Freon RefrigerantWould you believe R22 Freon won the southwest? OK, maybe not all by itself.

Yes, there were many reasons to settle the southwest. But without R22 Freon, central air conditioning may not have happened. NO A/C, fewer people, smaller economy, fewer jobs, etc.

R22 Freon makes summers in Arizona comfortable. But R22 refrigerant contains ozone-depleting CFC’s. Although efficient for air conditioning systems, but any leaks of R22 Freon deplete the ozone layer.

R22 is a greenhouse gas. Manufacturing R22 creates a by-product that contributes to global warming. This leads the EPA to take action to phase out the manufacture of R22 Freon.

The myths surrounding the phase out and R22 replacement are many. The facts not well understood.

R22 Freon Refrigerant Phase Out

Manufactures could not build equipment, pre-charged with R22 Freon after January 1, 2010. All “pre-charged” A/C systems had to use R-410A refrigerant. Also know as “Puron”.

Transition to the new refrigerant created confusion about the future of R22 Freon.

Production of R22 Freon will stop by January 1, 2020. Manufactures will stop production of “Virgin” R22 Refrigerant. And imports will stop as well.

But, and this is important, recovered R22 will be available to service existing systems. And this will include new dry R22 Freon based A/C condensers.

But the end will come for R22 Freon refrigerant on January 1, 2030. After that date it will be against the law to service existing A/C or heat pumps with R22 Freon.

Rumors Abound

One of the big rumors is that R22 A/C condensers are not available. This is not true. They are available.

And you can charge them with R22 refrigerant. Either “virgin” or reclaimed.

A second rumor is that R-22 Freon will not be available after January 1, 2020. Again, as stated above, this is not true.

Production will stop, but reclaimed and recycled R22 Freon will be available. Albeit, more expensive. A lot more expensive.

The Rest of The Story

To convert a system from R22 to R-410A requires changes to system components. So, stay with your existing R22 Freon system as long as you can.

The Home Inspection Is A KEY Buyer Consideration

Don’t Buy a Home Without One!

Tucson Home InspectionA Home Inspection – there is only one thing to say about a Tucson Home Inspection – Don’t Buy a Home without one!

The first clue that a home inspection is important is that it’s a contingency in your offer to buy a home. Section 6 “Due Diligence”.

The real BIGGIE is that a home buyer can cancel an offer to buy a home “for any reason DURING the inspection period. That is in Arizona, anyway.

Under that situation, the buyer’s earnest money gets returned. No questions asked.

What Does the Home Inspection Cover?

A Tucson home inspection gives a home Buyer detail on the condition of the home they are about to buy. The Tucson home inspection report identifies conditions that need repair.

Also, a home inspection can expose hidden health and safety issues that exist within the home. Every home inspector will provide a written report on what they found.

The home inspection report identifies steps taken and any limitations effecting findings.

The home inspection report will cover all major systems in a home and appliances.

Major systems include:

  • foundation,
  • electrical,
  • roof,
  • A/C, heating,
  • and plumbing.

The home inspector also will check the operation of the

  • stove,
  • oven,
  • and dishwasher.

And the home inspector will make observations on the general condition of the structure and other items.

Most Tucson Home inspectors take photos of any items they identify as needing repair. They will describe the condition and actions to repair the item.

The Inspection Report describes the condition of the home in the inspector’s view.

When a buyer is at the inspection, the inspector will review the Inspection Report with them.

The Inspection Is Done….Now What?

Upon receiving the Tucson home inspection Report, the Buyer has 3 courses of action.

1- Accept the home without requesting any repairs and proceed to closing.

2 – Reject the home based upon the issues raised by the inspection.

3 – Formally request the seller to make stated repairs to the home.

When The Buyer selects #3

We will prepare the “Buyer Inspection Notice Seller Response” form. Known as the “BINSR“. It identifies all repairs the buyer wants the seller to make.

The Seller now has 3 options:

1 – Agree to make all requested repairs and proceed with the sale.

2 – Agree to make some, but not all, of the requested repairs.

3 – Refuse to make any repairs.

Should the Seller select either option 2 or 3.

The Buyer now has TWO (2) options.

1 – Cancel the contract due to the Sellers not making all repairs

2 – Accept the Seller not making repairs and proceed with the purchase.

While this process sounds complicated it is actually straightforward.

The Arizona residential purchase contract sets forth all standard timelines. But if agreed to, the buyer and seller can agree to change them.

We are, of course, there to explain and review the options available in each step in the process.

In Arizona a home inspection occurs when a buyer makes an offer on a property and the seller accepts the offer.

The buyer has 10 days to hire a home inspector and complete all inspections.

Once agreed upon, the seller is to complete all agreed to repairs before close of escrow. The seller must also provide paid receipts for the repairs to buyer 3 days before the close of escrow.

But sometimes contractor scheduling gets in the way of meeting the deadline. And sometimes Buyers want to close escrow before the seller completes the repairs.

There are many reasons for this, but it is never a good idea to do it.

So, what are the risks?

The Scenario:

After the home inspection and BINSR submission, the Seller agreed to complete a roof repair requested by the Buyer.

But due to scheduling, the roof contractor could not complete the repairs before the close of escrow. But the buyer still wants to close on time and move in.

So what do they do now?

The seller purposes, and the Buyer agrees, a perfect solution. The seller will pay the roof contractor’s invoice to repair the roof at close of escrow. Making the payment from the proceeds from the sale of their home.

Then the contactor will complete the repair after the close of escrow.

The Seller asks the roofing contractor to submit an invoice. The key point here – it is not a proposal!

Sounds like a good plan, right? WRONG!

Almost all the risk is on the buyer with this plan of action.

What are the risks?

For one, the roofing contractor gets paid at close of escrow. Before completing the work

Since the contractor has the money, they could delay the repair work. They might schedule new work ahead of the buyer’s home. Remember, the work is already paid for.

The contractor might not complete the job or not complete it in a workmanlike manner.

NOTE – Seller and Buyer could agree to an “escrow hold-back” at close of escrow. The escrow company holds the funds. In this situation, the roofing contractor would not be paid until the repairs were completed to the Buyer’s satisfaction. Any cost over runs would still be the Buyers responsibility.

DANGER!

The job needs more work to complete. More than the contractor got paid. These added costs will be the Buyers responsibility.

Our recommendation is ALWAYS wait for the repairs before closing escrow.

How? The simplest way is for the Buyer and Seller to extend the close of escrow date. This allows the work to get done AND the Buyer to do a final inspection or “walk through”.

Other Property Inspections That Buyers Should Consider

Tucson Termite Inspection and Tucson Roof Inspection also provide valuable information to the Buyer’s purchase decision.  Some Buyers want to have Tucson Radon Inspection or Tucson Mold Inspection.

If suggested by the Tucson Home Inspection a Tucson Structural Inspection or Tucson Pool Inspection may be required.

Should the property have a septic system a Tucson Septic Inspection will be required.

Each Tucson home inspection follows standards established by the American Society of Home Inspectors. These standards are adopted from the American Society of Home Inspectors (ASHI) 1992 Standards of Practice.

The Termite Inspection Is A MUST in Arizona

There are four types of termites in Arizona.

Like bees, termites are social insects. Each termite in the colony has different functions.

Ok, this is TMI, but may be interesting to some readers.

Workers are responsible for feeding and maintaining the colony. Soldiers defend it.

You find Swarmers in the reproductive caste, and that includes the queen. Their job is expanding the colony as well as creating new colonies.

As expected the queen’s job is to produce eggs, ensuring the colony’s population continues.

Types Of Termites

Desert subterranean termites.

This specie thrives in extreme dry heat. So, it’s no surprise they’re found in Arizona, particularly the southern parts of the state.

subterrian termitesYou may find them living in desert plants. For example, a cactus. But they’re also attracted to the soft, porous rings in timber.

When they eat, the damage left behind resembles honeycombs.

Desert subterranean termites don’t need dampness as most other termite species need. They love dry wood.

Finding drop tubes from ceiling rafters, sheetrock, or plasterboard show an infestation.

Arid subterranean termites

They are the most common in Arizona and thrive in many environments.

Termites aird subterrianYou find them in deserts but also in canyons, rivers, sand dunes, and high altitudes (above 4,000 feet).

Swarming season varies according to the altitude but occurs sometime between May and October.

Coloring ranges from dark brown to black, and wings are practically translucent except for the veins.

Western drywood termites

As their name would imply, they love dry wood. But they are thrive in coastal areas.

Each colony housing around 2,000 termites.

Termites create chambers by eating across the wood grain, with tunnels connecting them. Walls within the galleries and tunnels are smooth and free of soil.

You may also see “blisters” on the wood surface. These are from enlarged galleries close to the surface.

Desert dampwood termite.

dampwood termiteThis specie is not common in Arizona. No surprise, it isn’t very damp here and their diet relies on wood with a high moisture content.

But they are here. This subterranean species loves citrus groves. They also eat living trees and shrubs, infesting the wood from below ground.

This species takes its moisture from the sap of these living plants.

Infestation occurs at or below ground level. Untreated poles, fences, and posts that are in direct contact with the soil are a favorite home for them.

The Termite Inspection

A termite inspection is a requirement of most Mortgage lenders. Lending underwriters want to be sure there isn’t any structural damage due to termites.

The Arizona Residential Resale Real Estate Purchase Contract provides the buyer an “inspection period“.  The “standard” Tucson Home Inspection period is 10 days. The termite inspection and all other inspections must be done within this period.

When the inspection is done, the Termite Inspector will prepare a Termite Inspection Report.  It will usually be a 2- or 3-page report. The termite inspection report will identify any evidence of Termite activity.

As a buyer, recognize that Termites are inherent to the Arizona climate. Don’t be alarmed should Termite activity be identified. In most circumstances, you should request the Seller have a Termite treatment done as part of the “Buyer Inspection Notice – Seller Response form.

Other Inspections To Consider

A Tucson Termite Inspection is usually done in conjunction with the Tucson Home Inspection. Should you desire to have a Tucson Roof Inspection, we will recommend a Roof Inspection Companies to consider.

As with the Tucson Home Inspection, the Termite Inspector with provide a written report for your review. Should the Structural Inspection identify any issues, we would include them in our repair request to the sellers.

Some Buyers want to have Tucson Pool Inspection and Tucson Mold Inspection since these inspections also provide valuable information in the final purchase decision.

Other inspections that might be recommended by the Tucson Home Inspector.
