One study found that respondents’ average length of a construction dispute was 17.6 months. If you’re hiring a contractor, you want the job done promptly.

Unfortunately, this doesn’t always happen.

Sometimes, there are unforeseen issues that your contractors encounter during construction. Other times, your contractor isn’t prioritizing you.

If your contractor takes too long, you need to know your options. Keep reading to learn the best ways to give your contractor a nudge – and what to do when that fails.

Why Is Your Contractor Taking So Long?

Before you start making any demands of your contractor, it’s best to know the whole story. Your contractor could take longer to finish your home improvement project due to unforeseen complications or issues they must resolve before the work can continue.

For instance, if you hire a roofing contractor for a roof replacement, they could encounter rot in your roofing materials, which means the contract duration will likely need to be extended.

Or, if your contractor is taking too long, this could be due to a lack of supply for the products they need to finish the project – which means your product will only be completed when these materials come back in stock.

A responsible contractor will always keep you in the loop, so you’re always aware of the project’s scope and how long it will take. However, this often isn’t the case. Asking your contractor why it’s taking so long will help you to understand whether you need to intervene.

When Your Contractor Is Taking Too Long – Your Options

Here are your options when your contractor is taking too long – and not giving a good reason.

Keep Your Contractor Accountable

When your contractor takes too long, you must document all communications and work performed to hold your contractor accountable.

If your contractor says your new kitchen cabinets will be complete by the end of the week, and you have evidence that it hasn’t been completed by the week’s end, you can use it to hold your contractor accountable.

Approach your contractor with the evidence and state that you’re not happy. Frequently, showing your discontent with the service will give your contractor the nudge they need to make more progress with the project.

Refuse Payment

If you suspect your contractor is drawing out the length of the project to create more billable hours, you have the right to refuse payment. Offer to pay for the cost of services to the projected deadline instead of the actual deadline.

Your money gives you leverage in the situation, and if you use it during the project, you can ensure your contractor knows the consequences of their slow service.

Of course, while this is a decisive move, you should always use respectful language when communicating with your contractor – this is a business interaction, not a personal one.

Leverage Reviews

In addition to having money on your side, you can leverage reviews to make the construction process go in your favor.

If you’re unhappy that your contractor is taking so long, you can threaten to leave a negative review for the service. Let your contractor know that you’re dissatisfied with the contractor’s service and that you wish to leave a review to let others know that the service is slow and they might not complete their projects on time with this contractor.

Since many homeowners use reviews to decide which contractor is suitable for their project, a negative review could be costly for the business. Hopefully, this threat will be enough to get your contractor moving.

Go To Senior Management

If you’re not dealing with one of the higher-ups in the company, you can always go to senior management to resolve your issue.

Typically, senior management will intervene to confer with your contractor about the project and why it is taking so long. If there isn’t a good answer, the senior managing authority will take disciplinary action to ensure your project gets finished on time and in line with company values.

Take Legal Action

In severe circumstances, when nothing you do can sway your contractor to finish the project, it’s within your rights to take legal action.

When you hire a contractor, your home becomes a building site. You could be without a kitchen, bathroom, or living area for months. If your project goes on for too long, this has a tremendous impact on your quality of life.

To take legal action, you’ll need documented evidence of your contractor’s proposed deadlines and failure to meet said deadlines. If your contractor has been rude or disrespectful in communications, you may also wish to include this evidence in the claim.

Simply filing a claim might be enough to get your contractor to take you seriously and finish the project swiftly. If not, you could be entitled to compensation – or at the very least, you won’t need to pay for the services.

And Remember – Be Respectful

No matter how poor the services of your contractor are, you win more flies with honey than with vinegar. If you use disrespectful language with your contractor, you could tarnish the relationship, and it could turn sour.

On the downside, Landscaping, window treatments and paint are on YOUR DIME!

Also, some new home builders allow you to make some design decisions to suit your personal tastes. Of course, these “upgrades” add to the price of the home.

Buying a new home can be as easy as walking into a recently built home the builder has in their “inventory”. Builders usually want to sell these as soon as possible.

So, if you like the home as built you may have a quick and easy deal.

Standard – Semi Custom – Custom

Building a new home on an vacant lot is a little different. Now you not only need to choose a floor plan, choosing options and upgrades become a big part of the process.

If you are building a custom home, you should plan on even more steps, more time, more choices and more money.

For those using a mortgage to buy a new home, get pre-approved before you start looking. Understanding the amount, you can borrow will help you make the better choices along the way.

And don’t forget the extras! Landscaping, window treatments, potential property taxes and HOA dues are just a few. The builder will usually provide minimal landscaping in the front of the home. The backyard landscaping is usually the buyer’s responsibility.

Here are 5 important things to consider when buying a new home.

1 – When Buying a New Home Always Look Before You Leap

Nothing beats the feeling of building a new home. Everything is new. No dust, no scratches, nothing to “re-do”.

Although straight forward, building a new home aren’t for everyone. Take a hard look at your specific situation. If you are buying a “spec” home or having one built in a new subdivision, as yourself;

  • How far away is the new subdivision from work, the city center and activities you want to do?
  • Will you mind the commute if it is necessary?
  • How long will it take to finish the new subdivision?
  • Does the cookie cutter nature of a new subdivisions bother you?
  • Do you mind the potential closeness of homes and potential lack of privacy?
  • Do the amenities of the new subdivision meet your interests?

2 – Explore New Home Subdivisions and Builders

When building a new home, consider using a real estate agent to work with. The agent will be your advocate though out the entire process. When selecting a real estate agent, remember

  • The new home sales office agent works for the builder and NOT you.
  • The sales agent is trying to sell a new home, not help you make the better decision for you and your family.
  • As soon as you select a Realtor to work with, tell them you are buying new construction.
  • Your real estate agent must go with you on your first visit to any new home sales office and register you.
  • Using a Realtor does NOT cost you any more. Builders want Realtors to bring them buyers.
  • Work with your real estate agent to research new subdivisions and homes for you.
  • Drive around the neighborhood and check out the amenities and the quality of the homes.
  • Visit the model homes.
  • Take notes and photographs to help you remember what you saw.
  • Ask if there will be a homeowners’ association (HOA). HOA fees and rules will vary quite a lot.
  • Are you willing to wait for the subdivision to be “built out”?
  • Ask your agent about shopping and amenities in the area.

3 – When Buying a New Home Understand What’s Standard and What’s Extra

Amenities are features that benefit the entire community. This would include items such as a clubhouse, health and fitness center or a gated entrance.

Upgrades refer to features or items you will need to pay extra for to enhance your home. This includes flooring options, appliances, lighting options and oversize windows or sliding doors.

Get the feature sheet for the homes you’re interested in. Read them and compare feature to feature between builders. Find out what comes with the base home price. Your Realtor will help you in doing this.

If you don’t understand exactly what the builder is offering, ask!  Take notes that include date, time and who said what. There are no dumb questions. Not knowing can cost you money.

Some other things to keep in mind:

  • Builders want you to make a lot on upgrades. But it may be better to buy the “standard” items and do the upgrade yourself after you close on the home.
  • When haggling over price, consider asking the builder to “throw in” some upgrades.  
  • They want to sell homes at the published price.
  • They might consider lot premium discounts and upgrades to sweeten the deal for a buyer.

4 – Even Though You Are Buying a New Home Have the Home Inspected

Most home builders don’t want the buyer doing inspections as they are building a home. Try to negotiate them into the contract. You don’t know what is behind the walls after the dry wall is up. You, the buyer, will pay for the inspector, but its worth it.

We always recommend to our clients have inspections done. It is amazing what the inspectors uncovered. Broken trusses, nails in electrical wires, nails in water pipes, and disconnected electrical wiring. Things you don’t see “behind the walls”.

Have the home inspected at each phase of building. After the foundation slab. Before dry walling. Times when potential problems are easy to spot. If the builder objects to this, consider it a red flag.

When buying new construction, builders provide various warranties on their work. Warranties will run from one to ten years. Appliances will come with manufacturers warranties. Review the warranty you receive to understand what is and isn’t covered.

5 – Consider Using the Builder’s Preferred Lender When Buying a New Home

Builders often have “in house” mortgage lenders or relationships to an outside lender. Using a builder’s preferred lender isn’t required, but it may save you money.

Also, contact two or three mortgage lenders for quotes. Understanding the “trade-offs” will help you in the long run. Ask your Realtor for some suggest lender contacts.

  1. You have the right to be represented by a Realtor when buying a new construction home.

Will they tell you there are homes listed for sale with the floor plan you want at less than it will cost you to build it?

You should question any builders integrity if they won’t let you do them.

These inspections show that all plumbing is in the right place for your floor plan selections. What is behind the drywall and if framing is complete. Are there broken trusses, damaged plumbing or nails through any electrical wires.

After drywall, no one knows what’s behind it.

 Rocking K Ranch is a 5,000-acre master-planned community in southeast Tucson.  Once an active cattle ranch Rocking K Ranch adjoins the 66,947 acre Saguaro National Park East.

This distinctive community in the Sonoran Desert will include resorts, golf courses, villages and a commercial complex. The masterplan includes 6,000 homes with a broad range of housing options available.

Properties will include custom homes, town homes and condominiums. Recreational areas and preserved open spaces are part of the overall plan for the community. Trails will wind throughout the community for hiking, biking and horse riding.

Families are served by the Vail School District.

The del Lago Golf Club is just a short drive away.

A Bit of History

The Rocking K Ranch community will sit in the Rincon Valley. This land became part of the United States in 1853 as part of the Gadsden purchase.

The Overland Mail Stage route was established in 1857.  The stage ran west from the San Pedro River at Benson, south of the Rincon Mountains to Tucson.  The route extended on to Yuma and California.

This route crossed the south and west sides of the Rincon Valley. The Southern Pacific Railroad, completed in 1880, followed essentially the same route as the stage line.

During the second half of the century land use in the Rincon Valley shifted from ranching to private residential development. Many of the 40-acre-plus ranches became 10 to 20-acre “ranchettes” during the 1960’s.

By the 1980s, several ranches in the valley became private residential neighborhoods. Development of a mixed-use, resort-oriented on the Rocking K Ranch begin in the 1990s.
